The platform you/you have, adtouro, makes it possible to realise exclusive luxury adventure trips and experience trips. It connects adventure seekers with the world's best specialist providers to enable unique, tailor-made experiences in the most exciting destinations. Whether diving, safari or climbing – with the mediation of highly qualified tour operators and the integration of luxurious comfort into every adventure, unforgettable travel experiences away from mass tourism are created. The platform offers access to unspoilt natural areas, exclusive accommodation, and personal support that ensures a smooth process from enquiry to booking.
By using the platform on the website, the world of exclusive, individually tailored luxury adventure trips and experience trips opens up. Here, discerning adventurers are networked with the world's best, specialised providers to enable unforgettable experiences in the most exciting and luxurious destinations. Whether diving in the deepest oceans, an exclusive safari or a spectacular climbing route – here you will find the right tailor-made trip.
1. Definitions and Scope
SCAILE Technologies GmbH, Jungfrauenthal 8, 20149 Hamburg, registered with the Hamburg District Court under the registration number HRB: 191310 (hereinafter referred to as “adtouro” or “Operator”), operates the adtouro online platform accessible under (hereinafter referred to as “Platform”). “Users” are all persons, whether consumers or entrepreneurs, who want to use or already use adtouro or users or entrepreneurs who commission adtouro with chargeable offers, planning, services or construction services via the platform.
These General Terms and Conditions (hereinafter referred to as GTC) apply to all users for the registration on the online platform, for its use and for all commercial actions carried out between the contractual parties in connection under the use of the platform. They also apply to future contracts, unless something different is expressly agreed or referred to when the contract is concluded.
By registering, the user confirms the inclusion of these GTC, which can be accessed at any time via the link. The contract text is not stored by adtouro. The contract language is German.
Terms of business of the users do not apply, even if the operator does not explicitly object to their validity in individual cases. Even if the operator refers to a letter that contains terms of business of a user or refers to such, this does not constitute an agreement with the validity of those terms.
2. Conclusion of the User Relationship
2.1. The user relationship between the operator and the user is established with registration or an enquiry from the user on the platform. A registration or enquiry is not required for the exclusively read-only access to publicly accessible content or services in the non-registration-required area.
2.2. Only users who are over 18 years old can send an enquiry and create a user account. The user is responsible for protecting their user account from unauthorized access by third parties. If the user wants to use services such as the analysis and offer creation on the website, at the end of the online questionnaire they will be prompted to enter their data in the respective registration form, e.g. their name, email address, and telephone number. The registration process can only be successfully completed if the necessary mandatory information is provided. By confirming the entered data, the user submits an offer to enter into a user relationship. The operator accepts the user's offer by sending an email to the user in which the registration is confirmed. With the receipt of this email by the user, the user relationship is deemed to be established. The user confirms receipt of this email.
2.3. Registration for a company may only be carried out by a representative and authorisable natural person named as the contact for the company. The operator can demand proof of identity or authorisation at any time.
2.4. Concluding the user contract and registration within the scope of the (automated) current status analysis and the non-binding consultation session do not result in any payment or other obligations for the user without the use of further (paid) services.
3.1. A contract for the use of chargeable services, such as consultancy services or project enquiries, is concluded by separate registration of the user for the respective service or by filling out and submitting the order form, and the acceptance of this offer by the operator through sending an electronic order confirmation or conclusively by making the service available. The operator may make the use of chargeable services dependent on an identity check of the user.
3.2. All offers from adtouro are non-binding and without obligation unless otherwise stated in the specific offer. There is no entitlement to registration or permission to access the registration-required project space (“My adtouro App”). The operator can create special registration requirements for individual offers at any time.
4. Services
4.1. Analysis and Offer
4.1.1. adtouro offers the option to carry out an analysis and offer creation on its platform. Within the scope of the analysis, the user provides more detailed information based on targeted questions and answer options. The adtouro technology analyses the necessary foundations for project realization based on the user's information, specifically automating the costs, efforts, benefits, and project processes that would result from potential projects and realizations. Subsequently, adtouro makes the result of the project, automatically calculated based on the entered data, available to the user after completing the analysis.
4.1.2. The user may only use the result of the analysis, offer overviews, or project processes for their own information or to commission adtouro or an external service provider/contributor mediated by adtouro with the planning and implementation of the planned project. Disclosure or making it known to other third parties is prohibited.
4.1.3. Please note the liability limitation in section 11.5.
4.2. Planning and Implementation of the Project by adtouro
4.2.1. adtouro usually submits an offer to the user after completing the analysis and/or the enquiry by the user.
4.2.2. If the user wishes to accept the offer from adtouro, they can do so by sending a binding order email or digitally signing the offer.
4.2.3. Billing is carried out by adtouro.
4.2.4. adtouro reserves the right to fulfill its service obligations to the user through a subcontractor.
4.2.5. As part of the consultancy, adtouro may also mediate additional external service providers who can implement individual or overarching measures. The following regulations (section 4.3) apply to the contractual relationship between the user and the external provider.
4.2.6. If a funding application is not approved, the customer will be reimbursed a proportion of the amount paid for the
